1.   ABOUT TERMS OF SERVICE

These terms apply to all purchases made at matijaro.com.

Please read these terms of use (“Terms of Use”) carefully before using this website (“Site"). The Site is operated by and the Terms of Sale were issued by MatiJaro Inc. (“MatiJaro”, “We", “Us”, “Our”). By visiting our site and/ or purchasing something from us,  or associating mobile or filling applications you engage in our “Service” and agree to be bound by the following terms (“Terms of Service”).

By making a purchase through this website or via telephone, you understand and agree to be bound by these terms and conditions and recognize that you may be waiving certain rights.

If you do not agree to these Terms of service and Privacy policy, then you will not be able to order any products or services through the Sales Channels.

You further certify that you are 18 years of age or older and that you have all the necessary rights, power and authority to enter into these Terms of Service.

We reserve the right to refuse service to anyone for any reason at any time.

 

2. INTELLECTUAL PROPERTY RIGHTS

 You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of  the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. 

Our Trademark may not be used, either as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated or used, in whole or in part, without the prior written permission of MatiJaro.

 

 3. LIMITATION OF LIABILITY

  In no case shall MatiJaro, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation: lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

INDEMNIFICATION. You agree to indemnify, defend and hold harmless MatiJaro Shop and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SEVERABILITY. In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

TERMINATION. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.


If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

GOVERNING LAW. These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Germany.

 

 4. PERSONALIZED SERVICES

 Personalization is available on certain creations, such as rings or pendants, to ensure that this special remembrance lasts with you forever. We offer engraving for our jewelry (monogram, symbol, special date. The product page on the website indicates whether personalization is available for the item. If you wish to have your MatiJaro creation engraved, please enter the text for the selected jewelry on the website. You are responsible for ensuring that any wording you provide for personalized products is correct. Orders for personalized products cannot be cancelled and cannot be returned to us for exchange or refund, as described in these Terms of Service.

Gift wrap. All orders will be delivered beautifully wrapped in our signature gift box and special packaging, together with a MatiJaro shopping bag.

Accompanying card. You may personalize your order by adding an accompanying card for a gift order.

 

 5. ORDERING

Once you have chosen a product, you may place this product in your shopping bag. To place an order, you may either register and create an online account, or place an order as a guest without creating an online account by selecting the "Guest Checkout" option. Where you place an order as a guest, we may still create an account on our internal systems to record your purchase(s). You should carefully check and confirm all order details and personal information on the order summary page before placing your order. Orders must not exceed three (3) products in any buying session.

 

 6. CONFIRMATION OF ORDER

 After placing an order, within twenty-four (24) hours, you will receive an e-mail confirmation from us that we have received your order. Upon shipment of your order, we will send you a second Confirmation of Order, which constitutes our acceptance of your order and indicates the existence of a binding sales contract.

Customer Service can place orders by telephone on your behalf. You will also be asked to confirm that you accept these Terms and our Privacy Policy with a payment link which will be sent to you by email.

Orders may be placed for personal use only, any commercial use is excluded.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice.

 

 7. PRICES

 MatiJaro prices for our products are subject to change without notice.

Prices include sales taxes/VAT but exclude shipping costs and other taxes unless otherwise stated.

 

 8. PAYMENT

All payments must be made at the time of Confirmation. The following network payment cards are accepted: Visa, Mastercard, American Express. You may also choose to pay by PayPal, Apple Pay, Amazon Pay, IDEAL.

  

9. SHIPPING

The MatiJaro offers items for sale worldwide. A sale is confirmed only once payment has been received by MatiJaro. We only accept orders for delivery to the country or countries that are identified during the Order Process. Please note that we do not ship to certain addresses, such as military establishments, certain restricted areas, pick-up points, or PO boxes.

MatiJaro reserves the right to divide the order into partial shipments. In this case, your credit or debit card will only be charged for a single shipment.

Delivery times communicated by MatiJaro shall be indicative only and in any case shall not exceed the maximum period of 30 days stated above. If delivery of products is delayed by an event outside our control, we will inform you as soon as possible and will use reasonable efforts to minimize the effect of the delay.  If you need your piece by a certain date, we will rush your order if possible and try our best to deliver by the required date. Please add the requested date in your notes or contact us for availability.

We will require a signature by you or a person at the nominated delivery address to confirm the delivery of each product. We reserve the right to deliver products only to the person named as the intended recipient of the order and to request ID check for verification purposes at the time of delivery for products.

We will send you an email once your order has shipped. Our orders are shipped by FedEx. Please contact your local FedEx on the telephone numbers below to receive further information.

 

 10.     INVOICES

 When ordering products via the Sales Channels, you will receive an invoice that will be sent to you in writing (to your e-mail address as a PDF attachment or otherwise).

 

11. RETURNS AND EXCHANGES

You may return any product that you purchased through the Website for a refund or exchange, within 14 calendar days from the date of delivery, subject to the following conditions:

 

  1. You must clearly inform us of your intention to return or exchange a product by completing the online return form at matijaro.com
  2. Once you have arranged your return, place the item(s) in the original shipping box and attach the return label to the outside of the box, then seal the box securely.
  3. Your order will be accepted for refund or exchange if returned in original condition with packaging complete and undamaged (boxes, accessories, protective materials, booklet, warranty).
  4. To complete your return, we require an original receipt or a copy in the case of a partial return.
  5. Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
  6. Your replacement piece will typically be sent to the shipping address indicated on your original order within two weeks.
  7. You should receive your refund within 7 - 10 business days after your returned item(s) is/are received at our office.
  8. Please note that personalized products, including products with customized engraving, may not be returned or exchanged.
  9. All returns must be received by us not later than 30 days from the day on which your order was delivered to you.
  10. All return shipments must be insured for the full amount and shipped back via FedEx. You will be refunded your full amount (minus shipping costs both ways) once the piece has been delivered back to our office.
  11. MatiJaro is not responsible for items returned to matijaro.com which are lost, damaged, misdirected or delivered late.

  12. Small variations in handmade products are not defects. Legal warranty rights apply.



12. UPDATES TO THESE TERMS

 We encourage you to periodically review these Terms  ― there may have been changes to our policies that may affect you. The latest version of these Terms of Service will always be available on the site.

If you do not agree to these Terms as modified, then you must not purchase products from the Website or via telephone.
